Re: Conduct Bone Ossification Tests of all Juvenile Offenders on Death Row in Pakistan

Sir:

SPARC is an organization working for the promotion and protection of child rights in Pakistan and has been working closely with the Government of Pakistan to improve the system of juvenile justice in the country.

The Juvenile Justice System Ordinance 2000 prohibits death penalty for individuals under the age of 18 years. However, several cases are coming into SPARC’s attention; about the dismissal of the review petitions of juvenile offenders seeking remission in their sentences on the grounds of age. In many of the cases children’s counsels had failed to raise the issue of age in the trials. One such offender Jawed Khan, of Shrengal Tehsil in Upper Dir District, was given the death sentence along with two other persons by an anti-terrorism court in Faisalabad on February 20, 1998. His counsel failed to raise the question of age at the trial court level.

In another case the death sentence awarded to Mohammad Amin by an anti-terrorism court was upheld even by the Honorable Supreme Court of Pakistan. The major ground for the dismissal of Amin’s Petition was his counsel’s failure to raise the issue of his age before the trial court.

We at SPARC request you to sympathetically look into these and other similar cases and order Bone Ossification Tests of all such offenders who claim to have been under 18 at the time of commission of crime.
