Establishment of Panel of Lawyers under the Juvenile Justice System Ordinance 2000 in the NWFP

On July 1, 2000 the Government of Pakistan introduced JJSO (Juvenile Justice System Ordinance 2000) to protect and promote the rights of all under-18 children who come into conflict with the law. On May 9, 2002 the Government of NWFP notified rules under the JJSO; subsequently, the Honorable Peshawar High Court designated the District and Sessions Courts as Juvenile Courts in the whole Province.

Honorable Sir:

On July 1, 2000 the Government of Pakistan introduced JJSO (Juvenile Justice System Ordinance 2000) to protect and promote the rights of all under-18 children who come into conflict with the law. On May 9, 2002 the Government of NWFP notified rules under the JJSO; subsequently, the Honorable Peshawar High Court designated the District and Sessions Courts as Juvenile Courts in the whole Province.

Under Section 3 of the JJSO a child accused of, or victim of, an offense, has the right to legal assistance at the expense of the State and provided by a legal practitioner with at least five years standing at the Bar. Under Rule 3 of the NWFP Juvenile Justice System Rules, a panel of legal practitioners shall be constituted by the Sessions Judges for the purpose of legal assistance at the expense of the State.

Tragically however, no such panels have been constituted in any district of NWFP. As a result, a number of male and female juveniles are languishing without legal assistance in different jails of the Province.

You are kindly requested to take note of this situation, and direct all the District and Sessions Judges to constitute panels of legal practitioners who could extend free legal assistance to the juveniles who are without legal aid.
